ABAWD Exemptions
Does the individual meet any of the following exemptions?
- Under age 18 or 53 years of age or older
- Certified physically or mentally unfit for employment
- Living in a household with minor children
- Pregnant
- Veteran
- Homeless
- Age 24 or younger in Foster Care on their 18th birthday
If YES – S/A May receive without time limits
IF NO – Proceed to Employed
- Is the individual employed an average of 20 hours / week or do they participate and comply with (WIA), (TAA), or (E&T)?
If YES – Proceed to (YES) K Months (See Instructions)
If NO – Proceed to (NO) K Months
- Has the individual received K months?
If NO – S/A Individual to receive 3 Full K months.
If YES – Proceed to Regained Eligibility
Regained Eligibility
- Have you regained eligibility? (80 hours in 30 days when not receiving benefits?
If NO – S/O individual not added to SNAP, must regain work history, exempt, or end of 36 months.
If YES – Proceed to Y Months
- Has the individual received their 3 consecutive Y months?
If YES – S/O individual not added to SNAP, must remain work history (M), exempt, or end of 36 months.
If NO – S/A individual may receive 3 Y Months.
K Months
- Has the individual received K months?
If NO – S/A May receive W months initial ABAWD meeting work rule
If YES proceed to Y Months
- Has the individual received their 3 consecutive Y months?
If NO – proceed to Break in Service(See instructions)
If YES – Proceed to Working While Receiving
- Did the individual start working while receiving Y months or has the individual regained eligibility since receiving benefits (80 hours in 30 days)?
If YES – S/A May receive M months regained eligibility meeting work rule.
If NO – S/O Not eligible must regain work history (M), exempt, or end of 36 months.
Break in Service
- Was there a break in service and the time started working average 20 hours per week?
If NO – S/A May receive W months Initial ABAWD meeting work rule.
If YES – proceed to Regained Eligibility
Regained Eligibility
- Has the individual regained eligibility? (80 hours in 30 days when not receiving benefits)?
If YES – S/A May receive M months regained eligibility meeting work rule
If NO – S/O eligible until regain work history, exempt, or end of 36 months.
