How to consider Bureau of Indian Affairs (BIA) Income
Exclude the following:
- Per capita payments, Osage head rights, income from mineral leases or other tribal business ventures distributed from judgment awards and trust funds made pursuant to P.L. 98-64.
- Income up to $2,000 per calendar year received by individual Indians, which is derived from leases or other uses of individually-owned trust or restricted lands. Any amount more than $2,000 should be considered as unearned income for following calendar year.*
- All funds paid to individuals under the Community Service Employment Program under Title V, P.L. 100-175. This program is authorized by the Older Americans Act and includes National Council on Indian Aging.
- To find out if the income is made available under P.L. 98-64, contact the Tribe.

- To inquire if the income is a tribal gaming payment, please locate the Tribal contact from the Tribal Gaming Contact List
*To assist in determining countable income, it is advised that TPI and IIM account verification should be requested each year on every tribal applicant or recipient.
Example:
- John Doe submitted a printout of income disbursements from his IIM account. Refer to image.
For SNAP purposes we look at the disbursement (payout) amount paid to individual; in this case $338.90. The dates of the statement 04/01/10 through 06/30/10 indicates that this occurs quarterly. Policy states to disregard up to $2000 per year. Any amount over that in a calendar year is considered unearned income. - Refer to ITS #3 340:50-7-22.
The client must provide proof of total disbursements received for the previous calendar year to determine how much, if any, of the income counts. When the client received more than $2,000, the amount over $2,000 is divided by 12 to determine monthly countable income. For example, when total disbursements equaled $2,100, the calculation is $2,100 minus $2,000 equals $100. The $100 is then divided by 12 to determine monthly countable income.
