The following are examples of “NEW” interpretations for Unearned Income.
Unearned income is countable for the person it is intended for even if the income is received by a third party.
Example 1:
- A child receiving SSI income resides with mom half of the month and the father the other half. The child is on SNAP with the father and the mother is the payee for the SSI payment of the child.
- With the new interpretation, the SSI income of the child would count on the SNAP case of the father as the child is included in his SNAP household.
Example 2:
- The grandmother is the payee of her grandson’s SSI payment. The child lives full time with his mother. The grandmother is applying for SNAP for herself.
- Even though she is the payee of the SSI payment, the child is not being included in the SNAP household therefore the income would not count toward the grandmother’s SNAP eligibility.
For additional information regarding third party and child support, refer to 340:50-7-29 (c)(3) and Instructions to Staff 9 & 10.
