TANF: Deprivation: Two Parent Households

There are 2 types of deprivation to consider when working a TANF application with 2 parents and children in common.

  1. Deprivation must be based on either incapacity or unemployment.
    • If one parent has health issues and is not able to work, and not receiving SSI, request medical documentation for an incapacity determination. 340:10-10-2
      • Send the medical documentation with a Medical Social Summary (ABCDM-80-D) to the Oklahoma Health Care Authority (OHCA), Level of Care Evaluation Unit, (LOCEU) for a decision on incapacity. Be sure to check the box showing you are asking for a TANF incapacity decision.
      • Check the MDL screen for a decision.
      • If approved, certify the TANF household, coding the incapacitated parent with “DI” (Disabled Individual) in the ET&E Status on the TANF Work tab, and entering the MDL diagnosis and review date in the Medical Section on FACS. If the non-incapacitated parent is needed in the home full time to care for the incapacitated parent, that parent is coded “CD” (Caretaker of the Disabled Individual) in the ET&E Status. The children in common should be coded “Incapacity” in the Deprivation Factor on the Deprivation
    • If both parents are able to work, but not employed, or earning less than the TANF income limit, see 340:10-10-3
      • Determine which parent is the Principle Wage Earner (PWE) using form 08TA002E (FSS-UP-1) to see which parent has the most work history.
      • Determine if the PWE has been unemployed 30 days, or is underemployed.
      • Determine if the PWE is available to work. See section above if not able to work due to health issues.
      • Determine if the PWE has received or would have been eligible for UIB in the last 12 months. If not then
      • Determine if the PWE has a work history of six or more work quarters in the last 13 consecutive quarters. Use the 08TA003E (FSS-UP-2), see: 340:10-10-10-3(b).
      • If requirements are met, certify the TANF household, coding the PWE as “Unemployed parent in two parent household determined to be PWE” in the Payee/spouse indicator and “RR” (Required Registrant) in the ET&E Status on the TANF Work tab. The children in common should be coded “Unemployed Parent” in the Deprivation Factor on the Deprivation tab.
    • If neither parent is incapacitated and neither parent meets the requirements for Unemployed Parent, deprivation does not exist for the children in common.
    • If the case meets requirements for UP and one parent becomes incapacitated after certification, an incapacity determination must be made by LOCEU.
  2. Work requirements for a two parent TANF incapacity case: 340:10-2-1
    • Incapacity
      • The incapacitated parent is not required to participate in TANF Work.
      • The non-incapacitated parent is required to participate 30 hours per week unless needed in the home full time to care for the incapacitated parent.
    • Unemployment
      • One parent must participate 35 hours per week
      • The other parent must participate 30 hours per week
