Aged, Blind, Disabled (ABD): Marital Status under SSI Criteria

A married couple is two people who are married by ceremony or common law and live together.

Common law marriage in Oklahoma requires the parties mutually agree of that they are married. Evidence of a mutual agreement to form a common law marriage includes cohabitation, actions consistent with the relationship of spouses, recognition by the community of the marital relationship, and declarations of the parties. All of the listed factors need not be present to form a common law marriage. Questions concerning whether a common law marriage has been formed should be referred to Legal Services.

If the worker receives verification of a marital status different than what SSI is using, the worker should inform SSI of the new marital status. The worker will then adjust the SSI benefit on the case. Refer to article Income – Adjusting SSI for New or increased Income.

How to determine the marital status SSI uses.

DHS staff can call their local SSI office to ask them what status is being used. There is also the SDX screen. SSI stopped using the marital status block (block 23) in SDX, but there are other blocks that may show what marital status is being used.

Block 17 Deemed Income if the client is not a minor or alien with a sponsor, the deemed income would have to come from a spouse.
