Long Term Care (LTC): Waivered Service Programs – Home and Community Based Waiver Services (HCBWS)

The program is referred to as the DDS (Developmental Disabilities Services) Waiver because that is the division which works with the individuals approved for this program.

People who receive services from this waiver require a nursing home level of care for people with intellectual disabilities. The level of care for this waiver is referred to as ICF/ID (intermediate care facility/intellectually disabled).

In order to have a categorical relationship to this program, as person must be:

  • Aged (65 or older), or
  • Blind or Disabled (per SSA rules), or
  • An individual who is not ABD-related meets the categorical relationship requirement if s/he is receiving TANF or in OHCA’s online enrollment population.

The individual must also have a diagnosis of intellectual disability before the age of 22 and be at least 3 years old to receive HCBWS.

Some, but not all, of the services available through the HCBWS waiver include employment and training supports, assistive technology devices and services, architectural modifications to the home, and other necessary supports for the person to remain in or move into a community based setting. Refer to Policy for additional information on what services are provided.

Financial eligibility is determined by AFS staff. MDL/MDI is checked for medical eligibility as well possible categorical relationship. This is a LTC program so income and resources are based on Schedule VIII (B) and (D).  Reviews are also financial eligibility reviews are completed by AFS staff. Applications and reviews must consider transfer of resources when determining eligibility for these services.

For Non ABD related, the individual must be in OHCA’s online enrollment population. If s/he is not in OHCA’s online enrollment population, eligibility will have to be determined through OHCA’s online enrollment process.
