Long Term Care (LTC): UpdatedProcess for Clients with Legal Representation

When a client is applying for / receiving medical services and had Legal Representation, it is imperative that you contact Legal to assist you with the process. The contact for Legal staff are JoshuaJ.Holloway@okdhs.org, Susan.Hohmann@okdhs.org and Susan.Eads@okdhs.org. If you have documents or issues for which you need a legal opinion, we ask that you please review the question(s) / issue(s) with your supervisor before your supervisor sends them to Legal staff to ensure that it is not something your supervisor can answer.

*Be sure to image all documents associated with the case.

Follow these general guidelines for cases with Legal Representation:

  • No direct contact with the client or their family unless you have consulted with the attorney;
  • By no means should the worker advise a facility to contact Legal directly. To get questions answered, the worker will need to follow the above protocol of staffing with the supervisor first to come up with a solution.
  • Use the attorney’s address/number as the point of contact for the client;
  • All communications with the attorney should be by email (except the telephone interview appointment). The email should include cc’s to Joshua J Holloway, Susan Hohmann, Susan Eads, and other staff listed in prior communications;
  • The worker should not be issuing a notice approving or denying an application without consulting with Legal staff.
  • Depending on the type of estate planning done, Legal will assist with specific questions/documentation needed about the instrument used. Examples of estate planning instruments are Trusts, LLCs, annuities, promissory notes, etc.;

NOTE: There may be additional instructions regarding your specific case. You will receive these from Legal staff.
