340:50-5-7.1(3) Residents of Institutions

Individuals are considered residents of an institution when the institution provides them with over 50% of three meals daily. These individuals are not eligible for SNAP unless they are residents of approved facilities. Approved facilities include group homes for disabled or blind individuals, treatment facilities for substance abuse residents, domestic violence shelter, and homeless shelters.

If an individual has over 50% of three meals daily provided and is not a resident of an approved facility, the individual is not eligible for SNAP. This may include students with meal plans, residents of boarding schools, hospitals, or other facilities where meals are provided.
