Aged, Blind, Disabled (ABD): Fleeing Felons

The following is a policy explanation on individuals who are fleeing felons with respect to the medical and SSP programs.

A fleeing felon is defined as a person who:

  • is fleeing to avoid prosecution, custody or confinement, after conviction under the laws of the place from which the person flees, for a crime, or an attempt to commit a crime, which is a felony under the laws of the place from which the person flees;
  • is violating a condition of probation or parole imposed under federal or state law;
  • has lost SSI benefits due to being a fleeing felon.

340:15-1-6 (d) A fleeing felon cannot be eligible for the State Supplemental Payment.

Oklahoma Health Care Authority removed all references to fleeing felons in medical policy [317:35]. A fleeing felon can be eligible for a medical benefit or buy-in if they meet all factors of eligibility.

If Supplemental Security Income (SSI) is closed because the person is a fleeing felon, the worker can use SSI’s disability decision for 12 months from their closure date. After 12 months has passed, send paperwork to LOCEU for a disability decision.
