TANF: WORK – TANF Recipient/Applicant with Pending SSI Application

  1. Immediately upon learning the client has applied for SSI and the client does not have private legal counsel, the Worker should complete a Disability Advocacy Program (DAP) referral with the client and submit for no cost legal representation through Legal Aid Services of Oklahoma. Client must sign the Referral for the Disability Advocacy Program 08TA010E (FSS- TANF- 4) in order for Legal Aid to speak with the worker. The original is forwarded to Legal Aid Services and a copy of the form is imaged into the case file.
  2. When a TANF payee has a pending SSI application and has a completed Work Tolerance Report (TW-27) and/or legal counsel, a good cause authorization is opened in the FACS Auth ET&E tab as he/she is not required to participate in the TANF Work program.
  3. TANF Review:
    • When TANF client HAS legal representation: a statement is requested from legal counsel regarding the status of the pending SSI application.
    • When TANF client DOES NOT HAVE legal representation, the Worker gives the client a Work Tolerance Report (TW-27) to be completed by their medical provider.
  4. When Worker verifies SSI has been approved, the TANF case is converted to a child only TANF and an Aid to the Disabled application is completed and processed.
