Long Term Care (LTC): How to Complete the Title XIX Worksheet (Community Spouse)

RESOURCES

The following are instructions / examples on completing the Title XIX Worksheet for Spenddown Computation for Cases with a Community Spouse (CS):

Part 1 – Community Spouse’s Share of Resources

  1. = Enter the couple’s total countable resources:
  2. = Enter ½ of the couple’s total countable resources:

Do countable resources exceed the Maximum Resource Standard on Appendix C-1, Schedule XI?

  • If YES, enter the Maximum Resource Standard:
  • If NO, enter one-half of A:

✔ If one half of A exceeds the Maximum Resource Standard, the amount above the Maximum Resource Standard is a resource to the institutionalized spouse (IS).

  1. Is the amount shown in B less than the Minimum Resource Standard shown on Appendix C-1, Schedule XI?
    • If YES, subtract B from the Minimum Resource Standard and enter.
    • If NO, enter 0.
  2. Community spouse’s protected share (B+C):

Part 2 – Computation of Resource Eligibility

  1. = enter Total countable resources of the couple that are available at time of eligibility determination. If Part 1 incomplete, enter Part 1, item A:
  2. = enter Community spouse’s share of resources. If (Assessment of Assets) Form 08MA011E was previously completed, enter the amount from item D on that form. Otherwise, enter amount from Part 1, item D:
  3. = enter Resources available to the spouse in the nursing facility or HCBW (A minus B):
  4. = check YES/ NO concerning Resource Eligibility

Example 1:

Mr. Smith (IS) enters the nursing home 08/01/22. Mrs. Smith (CS) will be remaining in the home. On the date of entry into the nursing home, their total countable resources were $30,000.

Community Spouse's Share of Resources

After completing Part 1, it is determined that the community spouse’s protected share is $27,480

computation of resource eligibility

After completing Part 2, it is determined that the client is not resource eligible for nursing care as the resources available to the (IS) is $2,520. It is necessary to spenddown to $29,480 ($27,480 for CS and $2,000 for IS)

Example 2:

Mrs. Wiley (IS) enters the nursing home 08/01/22. Mr. Wiley (CS) will be remaining in the home. On the date of entry into the nursing home, their total countable resources were $160,000.

Community Spouse's Share of Resources

After completing Part 1, it is determined that the community spouse’s protected share is $80,000.

computation of resource eligibility

After completing Part 2, it is determined that the client is not resource eligible for nursing care as the resources available to the (IS) is $80,000. It is necessary to spenddown to $82,000 ($80,000 for CS and $2000 for IS)

Example 3:

Mrs. Cash (IS) enters the nursing home 08/01/22. Mr. Cash (CS) will be remaining in the home. On the date of entry into the nursing home, their total countable resources were $18,000.

Community Spouse's Share of Resources

After completing Part 1, it is determined that the community spouse’s protected share is $27,480.

computation of resource eligibility

After completing Part 2, it is determined that the client is resource eligible for nursing care as the resources available to the (IS) is $0 (or less than $2000). No spenddown is necessary.
Why does it say the Community Spouse’s protected share is $27,480 when they only have $18,000 in Total countable resources?

If their total resources are less than the Minimum resource standard (Appendix C-1, Schedule XI) it just means that it is understood that the entire amount is probably going to go to the Community Spouse, unless they decide to give some resources over to the Institutionalized Spouse.
