TANF: ELIGIBILITY – Relationship of Child to Payee

If not bio/Adopted parent the payee must be with in the fifth degree of relationship.  Relationship of child to payee is relaxed verification unless questionable.

5th degree of relationship includes:

  • Siblings
  • Grandparents including great, great-great and great-great-great grandparents.
  • Aunts and Uncles including great and great-great aunts and uncles.
  • Nieces and nephews including grad and great-grand nieces and nephews.
  • First cousins and first cousins once removed.
  • See Appendix I-7 (08AX028E) for further details.

Spouse of 5th degree relative can be payee if

  • Married – spouse or relative can be included in TANF with the child if income eligible but not both.
  • Divorced – only if child was born prior to the divorce.
  • Death of relative – only if married to the relative and the child was born prior or during the marriage and before the death of the 5th degree relative.

If child was born after the divorce or death of the 5th degree relative payee is not eligible to receive TANF for the child.

If the child is adopted all the above rules apply to the new adopted family.
