SNAP: Income: Procedure for SSI Related Food Stamp Penalty Income(FSPI)

At times you will encounter SNAP cases that display a Food Stamp Penalty Income (FSPI). This is shown on block C.47 on the EC page in IMS.

If the FSPI is from SSI sanctions, then the following special procedures apply.

If you encounter a SNAP case with FSPI from SSI sanctions, first attempt to contact the Social Security Administration to check to see if the penalty income has been resolved. Sometimes the screen will continue to show FSPI, even though the penalty income has been resolved through the Social Security Administration.

If you are able to reach a Social Security Administration (SSA) agent, and they state that the penalty income has been resolved, you will then be able to use the FSPU transaction in IMS to remove the penalty income before processing the SNAP case. Be sure to document in case notes the name of the contact at SSA and date of conversation.

If the SSA agent states that the penalty has not been resolved, you would NOT remove the penalty income. Send the client an Adm-92 to contact SSA to obtain proof the penalty income has been resolved. If verification regarding the penalty income is the only verification that is outstanding, you would process the SNAP case with the penalty income on the case. You would not hold up a certification for SNAP to resolve penalty income issues.

You would also send out an Adm-92 to the client to contact SSA to obtain proof the penalty income has been resolved if you are unable to contact SSA. As before you would go ahead and process the SNAP case if the penalty income verification was the only item outstanding on the case.
