LIHEAP / ECAP: LIHEAP Hearing Request

Per policy 340:2-5-64 a hearing request must be in writing within thirty (30) days of the date on the notice. It must be signed by the client or their authorized representative.

OKDHS staff cannot sign the hearing request as an authorized representative for the client that makes a verbal request for a hearing.

If the client makes a verbal request for a LIHEAP hearing. Notify the client the request for a hearing must be in writing and that the request must be submitted to OKDHS within thirty (30) days of the date on the notice.

The client has the option to come into an office and complete the hearing request (13MP001E) or you can email the form to the client. The client must complete, sign, and return the form, either in person or by email.

If the client cannot sign the form electronically, OKDHS staff are NOT permitted to sign for the client as an authorized representative. This includes if the client calls and verbally requests that OKDHS staff sign on their behalf.

When the field staff receives a LIHEAP written hearing request signed by the client upload it into OnBase and send an email to the LIHEAP2 mailbox. Include the following client information:

  • Name
  • Case number
  • Email address
  • Telephone number
  • Energy Assistance decision the client wants to appeal

The Energy Assistance  program field representative (PFR) will notify the Appeals Unit. The PFR will complete the hearing summary and represent OKDHS at the hearing.

Note: If the hearing is OIG or BIR related and no documentation is in the case, contact the appropriate unit for documentation to support the action taken.
