National Voter Registration Act (NVRA): Voter Registration Offer

The following are FAQs regarding the Voter Registration Offer:

1. Does the client have to check Yes or No to the voter preference question on Form 08MP003E, Responsibilities & Signature for Benefits, form to continue to receive benefits?
No. The client has to sign Form 08MP003E, Responsibilities & Signature for Benefits, before he or she can receive or continue to receive benefits but does not have to answer the voter preference question. If the client does not check No on the form, explain that you must give or mail the client a Voter Registration Application.
2. Can I ask the voter preference question and enter a No in FACS without the client checking No and signing Form 08MP003E, Responsibilities & Signature for Benefits or Form 08MP007E, Voter Registration Statement?
A No must be in writing. If the client does not check No and sign Form 08MP003E, Responsibilities & Signature for Benefits, or Form 08MP007E, Voter Registration Statement, (or complete a renewal on OKDHSLive!), you must check Yes in FACS and give or mail a Voter Registration Application to the client.
3. Is a worker required to offer voter registration services to a client who is an undocumented alien or a known felon?
Yes, the worker must make the offer and record the response. When the client wants to register to vote, point out the oath on the Voter Registration Application where the client swears or affirms that he or she:

  • Is citizen of the United States;
  • A resident of Oklahoma;
  • 18 years of age or older;
  • Has not been convicted of a felony unless a period of time equal to the sentence has expired; and
  • Is not under judgement as an incapacitated person.

Staff should not refuse to give the person a Voter Registration Application.

4. How should I answer if a client asks me questions about the difference between political parties as I help the client complete the Voter Registration Application?
Tell the client that this is something you are not allowed to discuss as it might influence the client’s decision.
5. Am I required to offer voter registration services when a client submits an application or renewal through OKDHSLive!?
No, the client had to answer the voter preference question before he or she could submit the application or renewal. When you open FACS to complete the application or renewal, check “application, renewal, or address change, but the voter registration process has already been recorded for this action” on the first FACS Voter Registration Request screen.
6. Are staff required to keep completed Voter Registration Statements after they are scanned to the case?
No, after scanning, the paper copy can be destroyed.
7. What should I do if a client does not want to sign Form 08MP007E, Voter Registration Statement?
Explain the DHS is required to make the offer and if the client does not check No and sign Form 08MP007E Voter Registration Statement, you are required to give or mail the client a Voter Registration Application. If the client is in the office, hand the client a Voter Registration Application. If the client does not accept the application, tell the client you will mail one to him or her.
8. If I am completing an application or renewal with a client, is it better to ask the client to answer the voter preference question on Form 08MP003E, Responsibilities & Signature for Benefits, or on Form 08MP007E Voter Registration Statement?
Since the client must sign Form 08MP003E, Responsibilities & Signature for Benefits, form to receive benefits from DHS, there is no need to complete Form 08MP007E, Voter Registration Statement. Ask the client to answer the voter preference question on the Responsibilities form.
9. Am I required to offer voter registration services to a nursing home resident who is unable to comprehend what I am saying?
If you are completing an application or renewal, voter registration services must be offered to the person completing the interview with you. If you are completing the application or renewal with an authorized representative or nursing home staff, that is the person to whom you would offer voter registration services. If you are completing the interview over the telephone, make sure the person knows the voter registration application will be sent to the client’s address of record on the case.
10. I understand from the training that we should not send a client Form 08MP007E, Voter Registration Statement. How do I offer voter registration services when I send the client a benefit renewal form that does not contain the voter preference question and do not need to interview the client to complete a renewal?
Since Form 08MP004E, Renew My Benefits, and Form 08MA001E, Renew My Medical Benefits, do not contain the voter preference question, you may mail Form 08MP007E, Voter Registration Statement, with one of these forms. It is also acceptable to check Yes in FACS to the voter preference question to send the client a Voter Registration Application.
11. What do I do about offering voter registration services when the client returns the renewal form but not Form 08MP007E, Voter Registration Statement, if I do not need to speak to the client?
You are not required to call the client to make the voter registration offer if you do not need to do so for eligibility purposes. You would check Yes, a voter registration application will be mailed on the second FACS Voter Registration Request screen.
