Aged, Blind, Disabled (ABD): Income – Garnishment, Overpayment, or Deferments

317:35-5-42(a)(6)

For ABD-related benefits, gross income is used to determine eligibility. The gross is considered even if money is taken out for a garnishment, a lien, or an overpayment. Even if the overpayment is not due to fraud, count the gross. There may be times the entire payment is deferred due to the overpayment and/or garnishment. The gross income will still need to be counted towards eligibility.
